As real estate investment continues to dominate in the financial world, there are incidents of frauds in the market. With the growing number of real estate agencies, the Government has woken up to the need of laws to regulate the real estate transactions. All the states as well as the District of Columbia have enforced laws for licensing, regulating, and code of conduct for the real estate agents. The real estate industry has strongly supported real estate licensing law.
Objectives of the Laws:
Prevention of fraudulent practices is the major objective of the real estate laws. The real estate world is vulnerable to abuses. Hence, the court has made it mandatory for the real estate sellers to disclose all the essential information to the buyers for consumer protection. This document containing all the facts is called public report.
Codes of Law:
On August 4, 1943, a legislative power of the Department of Real Estate (DRE) was categorized as two Parts of the Division 4 catering to the Business and Professions Code. Part 1 is now known as Sections 10000 to 10580. It is titled, ?Licensing of Persons? and can be quoted as the Real Estate Law. Part 2 is called Sections 11000 to 11200. It is titled, ?Regulation of Transactions? and can be quoted as the Subdivided Lands Law.
The Requirement of A Real Estate License:
Under the Sections 10131, 10131.1, 10131.2, 10131.3, 10131.4, 10131.45, and 10131.6 of the Real Estate Law, the activities of the broker are defined. Under Sections 10131 (d) and 10240, et seq. of the Real Property Loan Law, the activities of the mortgage loan broker are defined. In the absence of a license, no compensation will be given to a person for carrying out any of the acts stated within the scope of a licensed broker. The law enforces penalties for an individual claiming to be a real estate broker without having a license. Any real estate broker who compensates a person without license for carrying out activities that call for a real estate license may be fined by the Commissioner. Further, a person who is found compensating an individual without license for services requiring a license shall be fined by the court and be found guilty of a crime under Sections 10138, 10139, 10139.5 of the Code.
Before going into a real estate transaction, it is better to get familiar with the rules and regulations pertaining to real estate. The buyer should know his or her rights to avoid sellers taking undue advantage. A well-informed buyer is able to get a fair deal from the real estate agents, and may even go to the court in case the agent strays from the law.

Real Life Real Estate Investing

I bought my first apartment 10 years ago, on my 20th birthday. I had spent the previous 5 years working and saving for college; but when I finally entered college at 19 on a full academic scholarship, I decided that instead of spending my accumulated savings, I would try my hand at investment.
Here I am 10 years later. What you’ll probably notice by looking at my site is that this is not a story of extreme or fast wealth building.
But it is a story of effective “forced savings” that has provided me significant insight into financial planning, real estate investing, and balancing the books. While it hasn’t always been a barrel of laughs, overall, I’m reasonably satisfied with the outcome so far.
I thought I would share some real world real estate investment thought. Let’s start at the end, where I am today: I currently own 7 condo apartments in my general geographic area. All of these condos are revenue neutral or revenue positive. I don’t have significant savings to fall back on, and I am just now in the process of “cashing in”, by selling my first apartment. My approach is best described as “slow and steady”; my outlook is 20 - 25 years.
Here the top points I like to share about investing in real estate:
1) Path to (instant) riches
I will never argue that real estate investing is an instant, or even particularly easy, path to significant wealth.My bank statement demonstrates that. I am willing to grant that many people are able to turn real estate in wealth quickly; I’m afraid that hasn’t my approach. Instead, I’ve taken the long view, as you can see at my site, with the hope that my real estate portfolio will provide a steady cash flow in 10-15 years time. For me, slow and steady really does win the race.
Just think about it: if you can manage to buy and hold 5 properties, within 15 years all five will turn in heavy revenue and heavy profit. For example, my two oldest properties now generate $3500 in revenue each month, with monthly expenses of just $1400. Imagine what that will look like once I’ve paid off all the mortages!
2) For a cautious investor, take the long view
This a vast generalization, but I hold to it pretty firmly: if your outlook is long enough, you will not lose money. At the worst, investing in real estate is a forced savings.
That’s not to say that you’ll never lose money; circumstances such emergency repairs, a destructive tenant, or rapidly inflating interest rates certainly increase the risk. But, if you can hold on through any such upheavals, you’ll find that within two or three years things will settle and you’ll start to benefit from increased appreciate in property value, increased rental income, or both.
And, while property values might dip for periods, keep in mind that over 5 years it’s virtually impossible that your overall property won’t appreciate. At the very worst, you’ll have paid down some of your mortgage.
Plus, you have a tangible, physical asset. There’s a lot to be said about that kind of peace of mind.
3) Operating costs - if they balance, you’re in the good!
You’re probably not going to earn back your down payment quickly - that’s ok! Keep in mind that the portion of your down payment that goes toward principle (ie: the part not eaten up by lawyer and realtor fees) is still in your hands. It just happens to now be in your property. You will see this money again when you sell.
So, the real goal is to be at least neutral on an operating basis. Ideally, that means that your rents will cover mortgages, strata fees, taxes and maintenance. This might not be possible for the first year or three, but even if you’re paying out a few dollars each month, you are still gaining more than if you were not investing.
4) Tenants - do your research,
I learned this lesson the hard way, when I had a tenant cause about $5000 in damage to one of my apartments. What I learned is that tenants have histories; if they are unwilling to share, or if you don’t receive sufficient references to make you comfortable, it’s probably better to just wait. Personally, I now ask for 3 references, and I require proof that the people I’m talking to are actually who they say they are (requiring a work phone number, for example). It might seem extreme, but this type of due diligence at the beginning increase comfort throughout a tenancy and reduce the chances of serious damage.
5) Tenants, Part Two - Late rent is forgivable - Once and don’t be afraid of the eviction notice
Real estate investing is a business. And, like many small businesses, it is sometimes operated on small margins. That means, if a tenant doesn’t pay their rent, it comes out of my pocket. I know that nothing works perfectly, so I will always forgive the first missed rent if there is a reasonable explanation. However, a second missed rent, and I will immediately begin eviction proceedings.
The laws of our state are very strict when it comes to evictions; there must be good and reasonable cause; here, at least, missed rent is just cause for eviction. Don’t misunderstand; I always keep an open mind. But many individuals will take advantage of a situation if they believe there is no consequence.
All in all, I’d say real estate investing has been a very positive experience and I would recommend it to anyone who has patience and fortitude. Do your research, though, because real estate investing has highs and lows, just like any other type of investment vehicle.

Real Estate Investing Strategies and the Economic Cycle

The Economic cycle plays an important role in real estate investing. The idea of an Economic cycle is simple. It states that what goes up must also come down. Although housing prices and real estate in general have had an overall increase in value for a great many years and there is confidence that the market will never crash completely. This has led many investors to consider real estate investment a secure thing, and their strategy is usually based on the long term potential of the investment. In other words, buy property and hold on to it until the profit you seek can be realized.
Although this strategy is not really bad for the long term investor, it will not enable him to realize the type of return that is possible when investing in certain profit rich areas such as Utah real estate. The cyclic nature of the Economic Cycle presents a danger that the market will be on a downswing when you are looking to unload your investment and the years taken to reach your goal might tie up your investment capital so that other opportunities are missed.
In an area such as Provo real estate, where profit potential is so great because of the attractiveness of the area for investing in properties that can be converted to rental units, the hold on to it strategy is a poor choice for the investor who wishes to make a solid return. There are other strategies that make much more sense. Even the Bargain Purchase strategy is better. In this concept, only properties that can be purchased at below 20% their true value are considered. The 20% figure allows the property to be returned to the market at once at its full value.
Another strategy that is related is the Increased Value strategy. This is going to be more likely in an area such as Provo real estate. It involves purchasing at the actual true value and making improvements within the first six months that increase the value by 20%, and then returning the property to the market at the increased value figure.
When rental property is the thrust of your real estate strategy, the Double Digit Cap Rate plan is a good investment choice. It limits your property purchases to those that can produce a capitalization rate of at least 10%. The capitalization rate is the net operating income of the property. The percentage figures in these strategies are guidelines for making the investment practical. If these minimum figures are not met, the investment capital should be invested in other low return investments and the real estate market avoided unless the hold on until it goes up strategy is used.

Everywhere you go, you hear the same sad things: ?The rich are getting richer while the poor are getting poorer.? ?There just isn’t enough to go around.? ?It takes money to make money.? This can lead you to believe that there is some mystical force out there that regular people like you and me just can’t tap into. If you subscribe to this way of thinking long enough, you may be tempted to say, ?Since it takes money to make money and I have no money, then what hope is there for me?? There is plenty of hope, as long as you don’t listen to the wrong people. Media naysayers are definitely the wrong people.
Press about the declining value of real estate as an investment or about skyrocketing housing prices that keep regular people out of the market altogether can make the prospect of making money through real estate investment seem almost ludicrous. Yet people are doing it ? real people like you and me. And you can do it too. All you have to do is listen to the right people.
Sounds easy doesn’t it? Yes it does. That’s because it is. It is very easy to find a person who knows how to make money by investing in real estate, find out what has worked for them, and apply it to your own life. If it’s so easy, you might be tempted to say, then why isn’t everyone doing it? And that, my friend, is the meat of the matter. Everyone isn’t doing it for two reasons. The first reason is that they’ve simply been told all their lives that success is very, very difficult. In fact, they’ve been told, because of the scarcity of money, success is almost impossible.
They are paralyzed because they have been listening to the wrong people.
The second reason everyone isn’t investing as they should is, it’s just too easy. If you look at the lives of successful people, those people have followed a systematic plan to increase their wealth. Well, systematic plans aren’t sexy. They aren’t interesting. They’re boring, and that’s why people don’t like them. Most people would rather have the adrenaline rush of a get-rich-quick scheme than settle into a proven systematic plan to let their wealth increase for them in the background of their lives.
Because most people think like that, those are the ideas that the media are catering to. That is why murder and mayhem is front-page news and happy things are not. That is why people slow down when they see an automobile accident and not when they see a couple holding hands. Tragedy is far more interesting. Just check out the plot line of any major motion picture. People like to believe that life is tough.
The good news is, it doesn’t have to be.
If you can break the habit of thinking of life in tragic terms, of convincing yourself that there is simply not enough money to go around, then you will learn to start listening to the right people so you can develop your systematic plan for investing. And what does a systematic plan lead to? Financial success. We’ve established that the media and the majority of their audience are the wrong people to listen to, but who are the right people? The right people are those who have invested in property and profited significantly from those investments.
Wouldn’t you rather listen to someone who can tell you how you can make money, rather than to people who insist on telling you how to stay poor?
