Real Estate Investing : Gross Lease

People lease commercial real estate properties using either a gross lease or modified gross lease or a net lease. Residential properties are usually leased under a gross lease with the exception of the utility expenses. A gross lease is also referred to as a pass-through lease or a full service lease. When a tenant leases a property using a gross lease, he pays a gross rent and the landlord has to pay the operating costs of the building risking rising operating expenses over the duration of the lease. A net lease refers to a lease where the lessee is responsible to pay for the taxes, insurance and maintenance of the property.

Types of Gross Lease: Full Service Gross Lease: In this kind of lease, the landlord is responsible for the payment of taxes, maintenance, insurance and utilities. All these expenses are included in the base rent paid by the tenant. The lessee is responsible for any property insurance, taxes and utility expenses beyond the permitted building standards. The lessee has to agree to pay his share of any increase in the operating expenses of the building.

Modified Gross Lease: In a modified gross lease, which is similar to a full service gross lease, except that certain basic services such as taxes, maintenance, insurance, janitorial services, electrical services etc. are excluded from the lease. This type of lease is commonly used in multi-tenant buildings where there are different tenants with different needs.

Commercial Gross Lease: The lessee pays the landlord a fixed monthly rent and the landlord is responsible to pay for the operating expenses of the building and its maintenance. The lessee pays for the utilities, maintenance, operating expenses, taxes as well as janitorial services. Industrial Gross Lease: The landlord leases an entire industrial building to a tenant. The tenant has to use the building as per the agreement in the lease, manufacturing and distributing and maintaining an office in it. The landlord will be responsible to pay for the maintenance, operating costs, taxes, insurance, utilities etc. that will be paid for by the lessee in the base rent.

The landlord has to take precaution against lessees with deceitful intent and make sure they verify any information provided by the lessee before signing the lease. The lessee, especially in a commercial building, has to make sure to find out if the lease includes only his office space or also parts of common area such as, hallways etc. The lessee has to make sure that he studies the terms of the lease carefully to ensure he is not paying for something that is not connected with his office space as if a new hallway built in another floor!

Everywhere you go, you hear the same sad things: ?The rich are getting richer while the poor are getting poorer.? ?There just isn’t enough to go around.? ?It takes money to make money.? This can lead you to believe that there is some mystical force out there that regular people like you and me just can’t tap into. If you subscribe to this way of thinking long enough, you may be tempted to say, ?Since it takes money to make money and I have no money, then what hope is there for me?? There is plenty of hope, as long as you don’t listen to the wrong people. Media naysayers are definitely the wrong people.

Press about the declining value of real estate as an investment or about skyrocketing housing prices that keep regular people out of the market altogether can make the prospect of making money through real estate investment seem almost ludicrous. Yet people are doing it ? real people like you and me. And you can do it too. All you have to do is listen to the right people.

Sounds easy doesn’t it? Yes it does. That’s because it is. Because most people think like that, those are the ideas that the media are catering to. That is why murder and mayhem is front-page news and happy things are not. That is why people slow down when they see an automobile accident and not when they see a couple holding hands. Tragedy is far more interesting. Just check out the plot line of any major motion picture. People like to believe that life is tough.

The good news is, it doesn’t have to be.

If you can break the habit of thinking of life in tragic terms, of convincing yourself that there is simply not enough money to go around, then you will learn to start listening to the right people so you can develop your systematic plan for investing. And what does a systematic plan lead to? Financial success. We’ve established that the media and the majority of their audience are the wrong people to listen to, but who are the right people? Using your 401k for Real Estate Investing

When people think about their 401k, they consider a lump sum of money that has been put away for retirement. In fact, most people completely forget about their 401k until income tax time. Creative real estate investors, however, have figured out that their 401k’s and real estate investing have a mutually beneficial relationship.

So with that being said, you are probably wondering how a savvy investor can use one for the other.

The easiest way that 401k and real estate investing can work together is through the ability to take out a loan against a 401k. The primary objective with real estate investing is to use little or none of your own personal money to fund the investment. Since you are allowed to borrow against your 401k, you can use this to finance part of your investment. When the deal closes, you will receive the amount you borrowed and then some. You can then easily pay back the loan without affecting your 401k. So, basically, it’s like a short term loan you make against yourself. You have access to the funds needed for investing, it doesn’t technically come directly out of your pocket, and when you finally cash in your profits, you simply pay yourself back.

There are some things to note about this method of investing, however. First, you should know that there is a cap on the amount you can borrow against your 401k. This amount is usually $50,000. However, it can be less, depending on the amount of money you actually have in your 401k. Another thing to note is that the real estate you purchase through this method is not eligible for the mortgage-interest tax deduction. There are no tax benefits when you use 401k to finance a portion of any real estate related transaction.

Another option for is to put the money into an IRA, or individual retirement account. Sometimes this is not allowed, but it if is, you will have more flexibility on what you can do with the money. You might receive a penalty for moving your money from your 401K. However, the penalty is usually worth considering given the benefits you would receive through real estate investing. Just keep in mind, the main objective is to only borrower the money for a certain period of time. As you wrap up each deal, its imperative that you repay yourself, and only hold onto the remainder of the profit.

If you are weary of the risks involved, there is a safer way to invest in real estate by using your 401k. Some plans offer the option to invest in real estate investment trusts. These trusts consist of companies that buy and sell real estate, which is a much less risky way of investing in real estate. It also requires less work on the part of the investor since the trust companies are the ones actually doing the real estate investing.

Most people are unaware of the many possibilities that exist by using their 401k’s to invest in real estate. It is a creative way for investors to make a profit in real estate without actually using their own money. The best part about it is that there are both safe and risky ways of investing with this money to yield a profit. The decision you make is one entirely of personal preference.
